Maintenance Schedule & Building Condition Reports

Section 115 of the Strata Schemes Management Act 2015 stipulates that the original owner (namely, the developers) of newly formed strata schemes must arrange for an initial maintenance schedule (IMS) to be prepared and provided to the Owners' Corporation. The Act states that owners must be supplied with a copy of the IMS at least 48 hours before the initial Annual General Meeting (AGM).

The IMS must detail the obligations associated with maintaining the common property areas and facilities not covered by the capital works fund. Such items include, but are not limited to, cleaning windows and pool filtration systems, lift maintenance, and any fire protection items. 

The IMS must also include details of all warranties, manuals, and manufacturer's maintenance requirements, along with the contact details of the manufacturers and installers for items included in the schedule.

While the Owners' Corporation is not obliged to comply with the maintenance schedule detailed within the IMS, it is strongly recommended that they are adhered to. Not doing so may result in an unfavorable outcome for owners' corporations where proceedings are taken against the original owner for defects or damages if it is determined that damages could have been avoided by following the recommendations outlined.
